5) What Are the Requirements for Filing a Request for Extension of Time?

See California Rules of Court, rules 8.212, 8.50, 8.60 and 8.63 and First Appellate District, local rule 11, found under the appropriate tabs on the left side and top of this page, for important information about extensions of time.

The rules require the party requesting the extension to supply sufficient copies and stamped pre-addressed envelopes for return of an endorsed copy of the request to all counsel or parties by the clerk. The application for extension of time shall be made by declaration. The request must be accompanied by a proof of service on all parties to the appeal or proceeding, and in civil cases the client must be notified of the extension request.

A request for extension of time form is available from the clerk's office or from the Forms section of this part of the website.
