I. Submissions in electronic form are supplemental to the required paper filings. The paper submissions remain the official version for the Court's purposes.
II. A party may file a CD-ROM containing one or more of the files listed below. If more than one party elects to make a submission in electronic form, the parties shall jointly submit a single CD-ROM containing the selected files.
(A) The submitting party(ies)'s filed appellate briefs.
(B) The Reporter's Transcript.
(C) The filed appellate record (clerk's transcript, joint appendix, appellant's appendix, and/or respondent's appendix).
(D) Documentary materials lodged in the superior court.
(E) Designated documentary exhibits.
(F) Legal authorities cited in the appellate briefs.
III. Under Paragraph II, the parties may file serial hyperlinked e-briefs -- a single CD-ROM containing (a) the reporter's transcript, (b) the clerk's transcript or a joint appendix in lieu thereof, including images of all exhibits, (c) copies of all cited authorities, and (d) all briefs, hyperlinked to each other, to the record, and to the full text of all cited authorities. Where less than all of the parties elect to file a hyperlinked e-brief, non-participating parties shall provide electronic copies of their briefs to the party (or parties) preparing the hyperlinked e-brief as a courtesy to the Court. Counsel must notify the Clerk's Office in writing of the intent to file a hyperlinked e-brief under this paragraph.
IV. Submissions in electronic form must comply with the following requirements:
(A) The files on the CD-ROM must be identical to the paper counterpart that has been filed in connection with the case.
(B) The CD-ROM must be Windows-compatible and readable on any windows compatible operating system;
(C) The CD-ROM must be finalized and in a .pdf format viewable using a program such as Adobe Acrobat;
(D) The CD-ROM must be free of computer viruses.
(E) The following files on the CD-ROM must be configured to allow searching, selecting and copying: (1) appellate briefs, (2) reporter's transcript, and (3) legal authorities. To the extent possible, counsel should comply with this requirement with respect to all other files on the CD-ROM.
(F) The CD-ROM may contain hyperlinks, but the hyperlink shall link only to documents on the same CD-ROM.
V. Time and Form of Filing
(A) The CD-ROM shall be filed not later than fifteen days after the filing of the final paper briefs, unless the court directs otherwise.
(B) One copy of the CD-ROM shall be served on each party separately represented. A certificate of service shall accompany each submission.
(C) Each CD-ROM shall be packed in a secure container, which may be paper or plastic.
(D) Each submission shall be labeled with the short title of the case, the Court of Appeal number, the submission date, and the names of the parties making the submission. The label shall appear on the CD-ROM itself and on the container.
(E) The parties shall file with the court five copies of each CD-ROM, along with proof of service on all counsel. No copies are to be served on the Supreme Court.
VI. Each original CD-ROM must be accompanied by a statement on a paper submission, signed by submitting counsel, that:
(A) The electronic submission complies with the requirements set forth in Paragraph IV above.
(B) Submitting counsel has viewed the material on the CD-ROM and has verified that it is identical to its written counterpart.
(C) The CD-ROM is free of computer viruses, including an identification of the software used to ensure it is virus-free.
For the parties' assistance, the following is a list of commercial vendors who prepare electronic submissions. There may be other vendors who also provide this service. Vendors can provide exemplars and cost estimates for their services. This list should not be construed as an endorsement by the Court, or an indication that the Court believes a commercial vendor is necessary to the preparation of the electronic filing.
