2-4. How do I file trial court exhibits on appeal?
A. The best way is to include your most important exhibits in the clerk's transcript or appendix. See discussion on Clerk's Transcript, in Question #2-2, above.
B. If you haven't included copies of the exhibits in either the clerk's transcripts or appendix, you may arrange to have the exhibits transmitted from the superior court to the Court of Appeal. Within 10 days after the last respondent's brief is filed, you must file and serve a notice in the superior court that designates any original exhibits that were not included in the clerk's transcript or appendix. Also serve a copy of the notice on the Court of Appeal. The Court of Appeal will provide notice to the superior court about the appropriate time to transmit the trial court exhibits. (Rule 8.224(a).)
