5-3. What are the procedures for requesting judicial notice?

A. Requests for judicial notice must be made by separate motion. Requests for judicial notice may not be included within a brief alone. (Rule 8.252(a)(1).)

B. Explain the relevance of the matters sought to be noticed. Include a copy of the matter to be judicially noticed, or explain why it is not practicable to do so. (Rule 8.252(a)(2).)

C. The court may immediately rule on the request for judicial notice, or may defer the ruling until it decides the merits of the appeal.
