15. When is a brief considered filed?

As provided in rule 40(k), CRC, the date of filing of a brief is the date of delivery to the clerk's office during normal working hours. However, the brief is considered timely if it is mailed via certified or express mail (documented by postmark or receipt), or delivered to a common carrier promising overnight delivery (documented by carrier's receipt) and the time for the brief's filing had not expired by that documented date.
