6. Time Limits for Filing Briefs

A: Time Limits (rules 8.25, 8.212, 8.216, 8.360, 8.412, and 8.416(e))

All parties will be notified when the record on appeal has been filed with the Court of Appeal.

From the date the record is filed, appellant has 30 days in a civil case or an appeal from a termination of parental rights within which to file appellant's opening brief. From the date the record is filed, appellant has 40 days in a criminal or juvenile case (other than a termination of parental rights) within which to file appellant's opening brief.

Respondent has 30 days from the date appellant's opening brief is filed to file the respondent's brief.

Appellant has 20 days from the date respondent's opening brief is filed to file the appellant's reply brief, if desired.

The minor's brief in a juvenile dependency case is due 10 days from the filing of the respondent's brief. (rule 8.412(b)(4))

Refer to Rule 8.216(a) regarding briefs when a party is both appellant and respondent.

B. Late Filing of Briefs

At the discretion of the presiding justice, permission may be granted to file a late brief if accompanied by a declaration.
