Child Support Project (AB 1058)
DRAFT 2001 REVIEW OF CALIFORNIA’S STATEWIDE UNIFORM CHILD SUPPORT GUIDELINE
The Judicial Council has commissioned a review of California's child support guideline, in accordance with state law (Family Code section 4054) and federal law (45 CFR 302.56). The review, which was prepared by Policy Studies, Inc., is currently in draft form. The Judicial Council seeks your comments on it, especially the draft recommendations for possible revisions to the guideline. The issues addressed in the recommendations section are:
- Treatment of low-income obligors;
- The use of gross income vs. net income as a base to use in calculating child support; and
- Treatment of children from prior or subsequent relationships.
Please see the comment sheet at this site for information on how to comment. When finalized and approved by the Judicial Council, the review will be sent to the California Legislature.
The review includes the following sections:
- An analysis of child support order information from case files;
- Areview of other states' guidelines, especially with regard to treatment of low-income obligors, use of gross income vs. net income as a base to calculate child support, and treatment of additional children;
- An analysis of the costs of raising children;
- Asurvey analysis on the guideline, administered to people who use the guideline (for example, judges, family law attorneys, litigants, parent/child advocates);
- Aseries of focus group findings with custodial and noncustodial parents who have experience using the guideline; and
- Draft recommendations.
