As the early Orange County experience showed, changes in rules, forms, technology, or whatever may be hard to accommodate. Support for lawyers and law offices can t be ignored, no matter how easy e-filing may (or may not) be. Toronto learned this; it s something courts are not well equipped to handle. The typical attorney in the Bay Area practices in 4 counties according to a survey of the Santa Clara Bar conducted in 1995. This supports the contention that e-filing should be universal and uniform; it is impractical to expect users to use a different interface for every court they do business with. We shouldn t expect that one vendor s solution will be implemented in all courts or used by all attorneys. K  B The prior work of the E-Filing Work Group seems to have arrived at the following points: Any solution must work with the existing installed base. It must accommodate, or be capable of accommodating any type of filing for any type of case in any jurisdiction. It must also be capable of accommodating pro pers, attorneys, and other interests. The user should not be troubled by different interfaces for each jurisdiction or even case type. Further, the  ideal user interface can vary by type of case or filing. In some instances a question-and-answer approach may be appropriate, in others a simulation of a JC form might work best. Ultimately, every aspect of filing should be accommodated electronically. In April the EFWG agreed that Legal XML was the best approach to the standards-setting process. CourtLink thinks it s a good idea. SCT wants CMS vendors to meet. Enforce it with the CA CMS certification process? It appears EFM software will be available from both EFSPs and CMS vendors, as well as from OXCI. Which is the right one for your court? @Court intends to make its EFM available to courts at no charge to anyone. CourtLink intends to charge EFSPs $2.50 a transaction, which could be a competitive issue if CourtLink underprices its e-filing service. EFM software will continue to evolve and will require substantial development efforts  some remuneration is appropriate for EFM vendors. The question is what must we do to prevent monopoly and encourage competition.
