Electronic Filing Projects in California Superior Courts

Superior Court of Orange County

The court has two active EFiling systems:

1) Complex Civil EFiling. This system provides the ability for all parties in Complex Civil to submit all documents electronically, and efforts are underway to eventually provide for electronic service of filed documents to all parties on a case. For this system, users are required to pre-register for an ID and Password. (Effective January 2004, all Complex Civil documents on cases can be Ordered to be filed electronically, with an Opt-out provision for fairness to those who do not have electronic access.)

2) Legal Aid Society of Orange County This is an external link. Click this icon for our external linking policy.. The court has partnered with the Legal Aid Society of Orange County to transmit data and PDF images using Legal Aid's I-CAN! kiosk system. The next phase will be to push availability to all Legal Aid customers via the Internet, as well as to expand to other case file types.

Small Claims E-Filing. Sacramento accepts Small Claims filings electronically over the Internet. They have also partnered with San Joaquin Superior Court, which now accepts Small Claims filings through the application and database hosted in Sacramento.

Unlawful Detainer E-Filing. Using the California Second Generation E-Filing Specifications, the Sacramento Superior Court developed an electronic filing system for unlawful detainer filings. Sacramento is the first court in the nation to accept electronic filings from multiple service providers.

Here is what the court has underway:

1) First is the Juvenile Delinquency Electronic Filing effort, which has been in place since 1998. This system, Juvenile Network (JNET), has components in place in the county's Probation Department, the District Attorney's (DA's) Office, Child Protection Services (CPS), Juvenile Conflict Panel Attorneys, County Counsel, as well as in the Superior Court. Following an arrest, the juvenile is taken to the Probation Department, where the arrest information is entered into its JNET system. The Probation Department then electronically submits a notice of the arrest to the DA's Office, where a petition is created on the DA's JNET database. Throughout the day a clerk at the court checks the JNET system for petitions to process.

2) The second project, which uses XML, also involves the DA's Office. Here, criminal filings from the DA's Office are submitted to the court. The court is moving into phases 3 and 4 of this project where both the DA and Public Defender will be electronically notified of any update to a case, hearings scheduled, Motions filed, and many other components based on numerous business rules.

3) Many of the county's cities have joined forces in a "Photo Red Light" citations effort. The court has an electronic interface with those cities to expedite citation collection. On a daily basis, the court receives files from the various vendors that maintain the red light cameras. These files get uploaded directly into the court's case management system; however, the court clerks do not input any data entry until payment is made or a hearing is scheduled.

4) New in 2005, the court will be extending its services with outside agencies by being able to process electronically submitted citations. These citations will primarily consist of traffic infractions, captured electronically by law enforcement on handheld devices in the field.

The court is accepting e-filings for designated complex litigation cases and asbestos cases using LexisNexis File & Serve. Additionally, the Court is considering mandating e-filing for all subsequent asbestos filings.
