Terms of Use

California's Second Generation Electronic Filing Specifications Project has produced the following electronic filing specifications (the "Specifications"):

The Specifications are available without charge by grant of license from the Administrative Office of the Courts, Judicial Council of California ("AOC") to an applicant (collectively, "Applicant", "User", "Users", "Licensee", "you").

To obtain a license to access and use the Specifications ("License") you are required to complete and submit the application posted at http://www.courtinfo.ca.gov/programs/efiling/application.htm. Notification of acceptance and grant of License will be sent to the email address you provide in the application. The acceptance notification will also provide you with the URL from which you will be able to access the Specifications. Completing and submitting the application to access and use the Specifications constitutes your agreement to the following terms and conditions set forth in this document and any changes to this document that AOC may publish from time to time (collectively, the "Terms of Use").

AOC reserves the right to amend these Terms of Use from time to time. In the event of a material change, we will notify you by email, sent to the email address you provide to us. If you continue to use the Specifications once you have been notified of the changes to the Terms of Use, you will be deemed to have accepted the changes.

Upon approval by AOC following your application, AOC grants to Licensee a royalty-free, non-transferable, perpetual License to use, copy, distribute, display and publish the Specifications. You agree not to create derivative works of, or modify the Specifications (excluding XML extensions as permitted by the Specifications) without the express written permission of the AOC. You also agree not to lease, loan, rent, sell, assign, license, or sublicense the Specifications, except as expressly authorized herein. This Agreement grants to Licensee no title or rights of ownership in the Specifications. All the Specifications made available by the AOC, including the Specifications provided herein, are protected by copyright or other proprietary rights. If you breach any of these Terms of Use, your License and authorization to use the Specifications automatically terminates, and any of the content downloaded or printed from www.courtinfo.ca.gov, or otherwise obtained from AOC, must be immediately destroyed or returned to AOC.

THE SPECIFICATIONS AND ALL CONTENT PROVIDED BY AOC ARE PROVIDED "AS IS" WITH NO WARRANTIES WHATSOEVER. ALL EXPRESS, IMPLIED, AND STATUTORY WARRANTIES, INCLUDING, WITHOUT LIMITATION, THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, ARE EXPRESSLY DISCLAIMED. TO THE FULLEST EXTENT PERMITTED BY LAW, AOC DISCLAIMS ANY WARRANTIES FOR THE SECURITY, RELIABILITY, TIMELINESS, AND PERFORMANCE BASED ON USE OF THIS CONTENT.

YOU UNDERSTAND AND AGREE THAT THE DOWNLOAD OR UPLOAD OF ANY MATERIAL THROUGH AOC'S WEBSITE IS DONE AT YOUR OWN DISCRETION AND RISK AND THAT YOU WILL BE SOLELY RESPONSIBLE FOR ANY LOSS OR DAMAGE TO YOUR COMPUTER SYSTEM OR LOSS OF DATA THAT MAY RESULT IN THE DOWNLOAD OR UPLOAD OF ANY MATERIAL.

EXCEPT AS EXPRESSLY PROVIDED IN THE PRECEDING PARAGRAPH, TO THE FULLEST EXTENT ALLOWED BY LAW, AOC SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, AND PUNITIVE DAMAGES RESULTING FROM THE USE OR PROVISION OF THE SPECIFICATIONS, EVEN IF AOC HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. THE FOREGOING DISCLAIMERS, WAIVERS AND LIMITATIONS SHALL APPLY NOTWITHSTANDING ANY FAILURE OF ESSENTIAL PURPOSE OF ANY LIMITED REMEDY.

All legal issues arising from or related to the use of the Specifications shall be construed in accordance with the laws of the State of California without regard to conflicts of law principles. These Terms of Use and any License granted by AOC constitute the entire agreement between you and AOC with respect to the use of the Specifications. AOC's failure to enforce any right or provision in these Terms of Use or License granted herein shall not constitute a waiver of such right or provision, or of any other rights or provisions in these Terms of Use. If a court should find that one or more rights or provisions set forth in these Terms of Use are invalid, you agree that the remainder of the Terms of Use shall be enforceable and that the invalid provision shall be enforceable to the fullest extent permitted by law.
