You are here: Families & Children > Parentage > How to Set Aside (Cancel) a Voluntary Declaration of Paternity > File a Form to Cancel a Voluntary Declaration of Paternity
A parent can sometimes cancel a voluntary declaration of paternity by filing a form CS 915 , Recission Form for the Declaration of Paternity.
The CS 915 form must be filed with the Department of Child Support Services within 60 days after the declaration was signed. If the mother and father signed on different dates, use the most recent date.

| Alert! A parent can't file a form CS 915 if someone has started a court action using the declaration of paternity. For example, a parent can't file a form CS 915 if the other parent asks the court for child support based on the declaration. |
If you can't file a form CS 915, you can file an action (called an "application") with the court to cancel the voluntary declaration of paternity.
