If you are NOT the spouse or domestic partner of the other parent, you can ask for a child support orders in these kinds of cases:

  
Domestic Violence Restraining Order

If you have been a victim of domestic violence, you can ask for child support orders when you ask for a domestic violence restraining order as long as the parentage of the other parent has already been established. Click here to learn about establishing parentage.

You cannot ask for spousal or partner support.

Parentage Case

A parentage case is for parents who are not married and have children together.

You cannot ask for spousal or partner support.

This kind of case says who the legal parents of a child are.

The judge can make child support orders in a parentage case.

Petition for Custody and Support of Minor Children

If you have signed a Voluntary Declaration of Paternity, you can file a Petition for Custody and Support of Minor Children (form FL-260).

This type of case lets the court make child support orders and other orders.

You cannot ask for spousal or partner support.

Local Child Support Agency (formerly the District Attorney) Enforcement Case

If the local child support agency files a case, it will ask the court for a child support order.
