What steps must a landlord take to legally evict the tenant?

In order to evict a tenant, the landlord must first:

  • Give the tenant specific, adequate, written notice of his intentions [see Landlord section for types of notices];
  • Wait for the notice period to end [see Landlord section for more info on how to determine whether the notice period has ended]; and
  • File an unlawful detainer lawsuit in court if the tenant does not do what the notice asks.
  • Have the tenant properly served with a copy of the summons and complaint so he or she has an opportunity to file a response to the lawsuit.
