Can an unlawful detainer be used to evict a tenant in every type of living arrangement?

No. The procedures for unlawful detainer cases DO NOT APPLY to:

  • A renter in a hotel or motel for a period of less than 30 consecutive days;
  • A single lodger in a private residence that is also occupied by the owner of the residence;
  • Transitional housing; or
  • Mobile home parks or recreational vehicle parks, where special rules apply.
