You are here: More Topics > Landlord/Tenant > Questions & Answers > What is the purpose of a "Request to Set Case For Trial - Unlawful Detainer"?
This request (form UD-150) asks the court to set a date for trial. When this request is filed, the court will schedule the trial on a date not later than 20 days after the request is made.
This "Request" is to be served on the other party, and the "Proof of Service" (form POS-040) must be completed and filed together with the request. A copy of the proof of service should also be attached to the copy of the request that is sent to the other party.
The other party has 5 days to file and serve a "Counter-Request," (also form UD-150) if he or she is not in agreement with the information or estimates given in the original request.
When the court has scheduled a trial for the case, it will mail a notice of the date to all appearing parties. (Normally, this notice is received in about one week.)
