Do you have the right to a jury trial?

Both parties in an unlawful detainer case have the right to a jury trial.

To request a jury trial, check the appropriate box in item 3 of form UD-150, at the time you file the "Request [or Counter-Request] to Set Trial - Unlawful Detainer."

The party requesting a jury trial has to deposit $150 with the court at least 5 days before trial. If the party is unable to pay the jury fees, he or she should request a waiver of jury fees at the time the request is made, by filing an "Application for Waiver of Additional Court Fees and Costs" (form 982(a)(20)).
