To serve means to give the other parent a copy of all the papers you filed with the court. But, you can't give the papers to the other parent. You have to get someone 18 or older, not you, to give the other parent a filed copy of the Petition for Change of Name (Form NC-100), Attachment to Petition for Change of Name (Form NC-110) and the Order to Show Cause for Change of Name (Form NC-120) (which has the court date on it) in person at least 30 days before the court date. The person who does this for you is called "the server".
The server has to fill out a Proof of Service of Order to Show Cause (Form NC-121) and give it to you.
You have to bring this Proof of Service to your court or file it ahead of time (ask your court clerk about any special rules about this in your county).
- If the other parent lives in California, you have to serve him or her in person.
- If the other parent lives outside of California, you can serve him or her by certified mail, return receipt requested. But, you can't mail the papers yourself. Another adult has to do it for you and fill out the Proof of Service.
